Maycreate agrees to provide digital marketing services as outlined in the selected package tier. Services include, but are not limited to, campaign management, landing page creation, CRM setup, call tracking, and performance reporting. Scope is defined by the package selected at enrollment and may be adjusted by mutual written agreement.
The one-time setup fee is due in full at the time of enrollment. Monthly management and media fees are billed on the same date each month. Media spend is held in a dedicated ad account and billed at cost with no markup. Invoices are due upon receipt. A 5-day grace period applies before a late fee of 1.5% per month is assessed.
Client acknowledges that the minimum monthly media spend listed for each package is a recommended floor. Spending below this floor may delay results and reduce campaign performance. Maycreate will not be held responsible for underperformance resulting from media budgets set below the stated minimum.
Services operate on a rolling month-to-month basis following an initial 90-day commitment period. Either party may terminate with 30 days written notice after the initial 90-day period. Setup fees are non-refundable. Media spend already deployed is non-refundable. Upon cancellation, Maycreate will transfer all client-owned assets within 14 business days.
Maycreate does not guarantee specific lead volumes or revenue outcomes. Lead estimates provided are based on historical benchmarks and are not contractual commitments. Campaign performance is influenced by market conditions, budget, competition, and other factors outside Maycreate's control.
Upon full payment of all invoices, client owns all creative assets, landing pages, and ad accounts created during the engagement. Maycreate retains the right to use campaign results and anonymized performance data for internal benchmarking and case studies, unless client requests otherwise in writing.
Both parties agree to keep confidential all proprietary business information shared during the engagement. This obligation survives termination of the agreement for a period of two years.
This agreement is governed by the laws of the State of Tennessee. Any disputes shall be resolved in Hamilton County, Tennessee.
